What is Collaborative Divorce?

The Collaborative Process is a method of alternative dispute resolution in divorce and other family law matters. Attorneys for each party agree to assist their clients to resolve conflicts by employing cooperative techniques rather than adversarial strategies and litigation. All of the people involved commit themselves to achieving a negotiated outcome. The parties and their lawyers enter into a “Participation Agreement” in which it is agreed that if a settlement is not reached, the lawyers will withdraw from the process and not participate in the ensuing litigation. Collaborative Law offers a number of benefits such as:

Benefits of Collaborative Law

  • Privacy: A Collaborative Divorce is a private and confidential process.
  • Efficiency: A Collaborative Divorce allows both parties to set their own timetable, avoiding the delays that can happen in the court system.
  • Guided team approach: The Collaborative Process is facilitated by a trained professional team that comprises lawyers, mental health professionals and other specialists who are able to guide each side to more effective communications, disclosure of information and problem solving.
  • Crafted settlements: The professional team works together to address issues effectively and to craft settlements that will meet the needs of everyone involved, including the children (if the matter involves children).
  • Final and durable agreements: Collaborative Process settlements crafted with the assistance of an interdisciplinary team have been shown to reduce the need to return to the courthouse once the final judgment is entered. That durability provides closure and allows the parties and the family to move forward with their lives.
